The hub of taxheaven.gr continues the effort for global and valid information of colleagues, with the scheduled discussions through the show "Dialogues with People", edited and presented by the hub's scientific partner George Christopoulos.
In today's show, he hosts the president of our organization, the Greek Chamber of Commerce, Konstantinos Kollias,with the help of his respected colleague Antonis MouzakisThe president will tell us quite a few things, both about the good news of the L/F issue regulations, and what the industry is waiting for.
But we will start with the question of the passing of the amendment on the disease of accountants-tax technicians and its history. An issue that had taken on the character of "odyssey" and that all of our colleagues accepted, listened to, learned about with satisfaction. However, it leaves no room for celebration and was rightly commented on as self-evidentsomething that, as we will see, both the president and us will stand by this word. Unfortunately - as we will be told - even as a self-evident solution, behind it there were several pressures, and several attempts to "understand" it by the decision-makers and those in charge and to make it a provision of the law. (note. already constitutes article 67 of Law 5042/2023).
For the information of visitors and subscribers of the hub and colleagues who deserve to see today's interview, we tell you from the beginning that it is interesting. Because the issue of the solution to the illness, as well as the issue of the limits on the signing of the L/F (even though my limit was reduced to 30,000 euros) and even the finesdo not cease to give a message, in the direction we would say of the "potential existence of the statutory role of the L/F" and that "the accountant - tax technician, the professional whose mission is to support the implementation of the tax policy of the State, has the right to its protection".
The other side of the message is that our profession can have a perspective for what we are entitled to but also a greater recognition, under the will to rally,in the opposite of course of the principle of protection, which guarantees institutionally, the OIE that supervises our profession, with a foundation principles and rules.
For your convenience , we list the individual points that we focused on with my colleague and friend Antonis Mouzakis under headings.
The first question is posed by Antonis with the provision on sickness, emphasizing it with the contribution of the OEE and the trade unions and the Federation.
We summarize some phrases and statements of the president Constantinos Kollias:
"Unfortunately or fortunately, in this country even for the obvious things we have to fight and OEE has shown that it methodically fights for the good of the industry all these years. An industry that lifted a very, very heavy weight during the pandemic, but it is still lifting the weight, because all this digitization done by the state, essentially goes through the accounting offices.
• For the disease, we took the first step in the pandemic, when the disease became the law of the state regarding covid and the extension of all obligations.
• Methodically,since then we started working because there were many people who told us "why didn't you proceed with everything and only go to covid". It was the first step, we said then, and methodically we will reach the goal, which is the self-evident thing we said before.
• At another point in the story, the president will emphasize: "...we took all these actions but we also had the undivided support of all the Unions in the sector. Because they were also the Federation with the unions that were pushing"
• Underlining the institutional solution of the issues through the Economic Chamber, the president will tell us: "In many cases we went to the ministers and they told us that Unions have also come and are pushing for this issue. And they said (note the ministers) to the Unions that were pressing for it: take it through the Economic Chamber, let it come officially from the statutory body so that we can do it. So I think that we all put a stone in place to achieve the obvious".
• Regarding the institutional meeting of the OEE board with the POFEE board: Therefore, speaking of a collective achievement, we wanted to ask the OEE president and render "Caesar to Caesar": You had protest pressures from the entire industry and of course through the trade unions Organizations. We will focus on POFEE, which you agreed to in a dialogue on the collapse of common issues and on the strategy for the further course of the Economic Chamber (see related. "Meeting of Presidencies OEE - POFEE on the problems of accountants-tax technicians", DT of OEE 07.11 .2022).
"We prioritized following the proposal of the POFEE Board of Directors three issuesThe first was sickness, which we got through. The second issue was the limits, the goal of which was to go to zero limits, and the third was the issue of fines." (note this issue is interesting and you will see in the video the entire reference of the president to our question).
In the hour-long (57 minutes) discussion with Konstantinos Kollias see also:
• The issue of fines that has not been completed (with the paltry sums for 0.70 cents or one and two euros of overdue initial withholding tax return e.g. bag, etc., continue to impose a fine of 250 or 500 euros)
• The issue of minimum fees or minimum costs (price list per type of service, etc.) • The issue of the regulation prepared by AADE for νόμο 4557/2018 and the due diligence measures of the L/F ("will be formulated in good agreement with the Governor and the OEE will submit his own proposal on what this regulation should be, always in the context of the other professions and after consultation to issue this regulation. , Notaries" will be analyzed by the president. • On the topic of this year's statements: "This is also the topic we will discuss tomorrow at the scheduled meeting with the Deputy Minister of Finance Mr. Vesyropoulos and the Governor of AADE Mr. Pitsilis, to put to them all the issues that are open with the pending issues of the application and the incomplete pre-completion due to the delay of several other agencies. We know from experience now in previous years. I remember that I reached out to the Prime Minister to inform him of exactly what was happening. (and more on this topic in the video).
• In the debate you will also see what they say about the issue of the provision of the disease and not only with the interventions of the Minister of Development and Investments Adonis Georgiadis, but also the MPs Tryfon Alexiadis and Vassilis Spanakis. (Note. MP Vassilis Spanakis, apart from the questions in the Parliament, was the rapporteur of the recent N/S, in which the voted amendment regarding the illness of the accountant-tax technician was tabled. Mr. Alexiadis has also "struggled" in the Parliament and he with a question and with document submissions of both the OEE and the POFEE). The president also made reference to the help he provided to OEE and PASOK. (note we would have had Mr. Skandalidisas well , but due to parliamentary work in the Parliament it was not possible to connect us, despite the help of the member of the KD, Mr. Papadimitriou).
• For the controversial issue of myDATA , the president received a lot of criticism from what we conveyed and we would say that he put the issues in their true dimension. To avoid fines, etc. “It is an application that has had problems since its inception. What you mainly said about costs has already been raised and discussed. I think with the consultation that we listen to, the problems can be dealt with and we can go step by step to reach the goal. Reference is also made here to the meeting of the Board of Directors of POFEE at the end of March with the Governor and the commitment from both sides to receive a technical report. Also in the work of the Committee of Accountants (and here more in the video and about the legal issue of physical documents , compared to the data from mydata, for which the liability provisions of the Law apply, only from article 38 of law 2873/ 2000, Law 3842/2010 and of course from the ELP - Law 4308/2014)
• About the work of the committee of accountants and what the president said,
• On the future of the "digital" tax accountant and the risks of the aggressive changes of digital technology and robotic accounting. How can the professional L/F be protected and be part of this technological development with the institutional care and protection of the Body (OEE).
• On the issue of TEI graduates and registration as members of the OEE (here again the president did not avoid answers. See in the video)
Also in the discussion, we asked Konstantinos Kollias to comment:
The relationship of the OEE with trade unionism ("... and here many problems will be solved when everyone understands their role. We at the Chamber of Commerce understand that the role of the Associations and Federations of the trade union bodies, i.e. industry bodies, is to collect the problems and to take them to the institutional body. The institutional body for observing the profession and the institutional body for economic issues vis-à-vis the State, from which we always ask for things, is the Economic Chamber of Greece. It is a great success that we are now going to the Government, we are now going to the Government ,to the each Government with specific arguments and we argue. And I dare say that in a percentage, over 70%, our requests are satisfied, through legislation passed by all parties.
• On how he receives the support of his colleagues in the KD of the factions and if they stand by the president's side ("....for the good of the Economic Chamber, all the factions become one fist. Or at least most of them so that I am not leveling. And this has reflection in the Parliament as well. It is no coincidence that both in the illness of L/F and in the legislation of the profession of the internal auditor that was given to the OEE and in other legislations, they may come from the government but they are also voted by SYRIZA and by PASOK, will say the president of the OEE")
• Regarding the issue of the provision of the internal electorate that was commented on by a certain faction of the KD, we asked (because we saw some objections) "and we here today on the show are not hiding anything, we don't want it to be seen that the discussion is watertight. Of course we also saw answers... see in the video what the president said about it.
Instead of an epilogue: We do not know nor do we keep it infallible, if with our questions and the conclusions you will find after you take the trouble and watch this interview with the most institutional and competent person of the Agency in our sector, we have wronged some side. I confess, however, that I and Antonis Mouzakis tried without purpose and with an objective filter to approach the hot issue of the disease and the other issues as an assessment of the conscientiousness of L/F at the altar of duty, under the adverse conditions during the period of the pandemic . Unfortunately, with its stance on this controversial issue, the economic leadership did not show the due reciprocity. The recognition, however, that his exemplary contribution to the effective implementation of the innumerable measures of the state to support businesses and taxpayers, even if slowly with the provision, leaves room for an effective dialogue that is not necessary.
